Real Estate Fractionals
I receive many inquiries about Fractionals this year. A few developers are pioneering fractionals in Destin and Walton County with WaterColor and Rosemary Beach’s Private Residence Clubs. These two are considered timeshares under Florida law; and must comply with Florida Statute 721 and very specific rules for advertising. The number one question I am asked is how well a fractional interest will appreciate.
F.S. 721.11 (4) No advertising or oral statement made by any seller shall:
(b) Make a prediction of specific or immediate increases in the price or value of timeshare interests.
(c) Contain a statement concerning future price increases by a seller which are nonspecific or not bona fide
